Terms of Use

The rules for using this website, and the limits of what a quote on it means.

The most important line on this page: nothing on this website binds insurance coverage. A quote is an estimate. You are not covered until a licensed carrier confirms it in writing. If you are ever unsure whether coverage is in force, call us and ask.

1. Agreement to these terms

By using shopsmartrate.com you agree to these terms. If you do not agree with them, please do not use the site. These terms are between you and SmartRate LLC, doing business as ShopSmartRate.

2. What this website is

This is the website of a licensed independent insurance agency. It exists so you can request quotes, learn about coverage, and get service on a policy we placed for you.

We are not an insurance company. We do not underwrite risk and we do not pay claims. We place coverage with licensed insurance carriers, and we access those carriers through the First Connect agency network. Every policy is issued, underwritten, and paid by the carrier, under that carrier's contract with you.

3. Quotes are not coverage

  • Any figure shown, quoted, or discussed is an estimate based on the information supplied and on the carrier's rates at that moment.
  • Estimates change once the carrier verifies driving records, loss history, property condition, credit-based insurance scores where permitted, and other underwriting factors.
  • A carrier may decline a risk, or accept it at a different price or with different terms.
  • Submitting a form on this site does not bind, alter, cancel, or renew any policy. Requests to bind, change, or cancel coverage are only effective when we confirm them and the carrier confirms them in writing.
  • Any illustrative comparison, sample figure, or example shown on this site is for demonstration only and is clearly labeled as such. It is not a quote and it is not an offer.

4. Your responsibility for accuracy

Insurance pricing and eligibility depend entirely on the accuracy of what you tell us. You agree that the information you provide is true and complete to the best of your knowledge, and that you will tell us promptly when something changes — a new address, a new driver, a new vehicle, a new business activity.

Inaccurate or incomplete information can change your premium, and in some cases can give a carrier grounds to deny a claim or rescind a policy. That is a serious outcome and it is worth being careful about.

5. Eligibility and licensing

You must be at least 18 years old and legally able to enter a contract. We can only transact insurance business in states where we hold a valid producer license and where the relevant carrier is admitted or otherwise authorized. If you are outside the states we are licensed in, we may not be able to help you yet.

6. Your Client Center account

If we have written a policy for you, you can sign in at shopsmartrate.com/login to view it. A few things about that.

  • It is a convenience, not part of your coverage. Your insurance is governed entirely by the policy your carrier issued. If anything in the Client Center ever disagrees with your policy documents or your carrier's own records, the carrier's documents are correct and ours are not. Tell us and we will fix it.
  • We may not always be able to show it to you. The Client Center can be unavailable for maintenance or for reasons outside our control. It is never the only way to reach us: call 855-USMART1 and a person will help you.
  • The sign-in link is yours alone. It signs in whoever opens it, so treat it like a key. Do not forward it. If you think someone else has reached your account, tell us and we will end every active session immediately.
  • Do not try to reach records that are not yours. Attempting to access another person's information, or to probe, scrape or interfere with the service, ends your access and may be unlawful.
  • We may end access. We can suspend or close a Client Center account — for misuse, or simply because you are no longer a client. Closing it does not affect your policy, and it does not change what we are required to keep under section 8 of our Privacy Policy.

Nothing you do or fail to do in the Client Center changes your coverage. Requesting an ID card, a change, or a renewal review through it is a message to us — coverage changes only once a carrier issues them and we confirm that to you.

7. Acceptable use

Please do not use this site to submit false information, submit information about someone else without their permission, attempt to gain unauthorized access to our systems, scrape or harvest the site, or interfere with its operation. We may decline service or remove access for any of the above.

8. Our content

The text, layout, graphics, and code on this site belong to SmartRate LLC and are protected by copyright and trademark law. You may read it, print it, and share links to it. You may not copy it wholesale for a competing commercial purpose without our written permission.

9. Third-party names and links

Any carrier or company name that appears on this site belongs to its owner and is used only to identify that company. Their appearance does not imply that they endorse us. This site may link to other websites we do not control; we are not responsible for their content or their privacy practices.

10. No warranty

We work hard to keep this site accurate and available, but it is provided "as is." We do not warrant that it will be uninterrupted, error-free, or that every figure or article on it is current. Insurance rules, rates, and carrier appetites change constantly. Nothing on this site is legal, tax, or financial advice. For advice about your specific situation, talk to us directly, or to a qualified professional in that field.

11. Limitation of liability

To the fullest extent permitted by law, SmartRate LLC and its members, employees, and agents are not liable for indirect, incidental, special, or consequential damages arising out of your use of this website. Nothing in this section limits any obligation we owe you as your licensed insurance producer, or any right you have under the insurance laws of your state. Some states do not allow certain limitations, so parts of this section may not apply to you.

12. Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Insurance policies themselves are governed by the law of the state in which they are issued and by the terms of the policy.

13. Changes and contact

We may update these terms. The date at the top of the page will change when we do, and continuing to use the site after that means you accept the update.
